These Terms of Service (“Terms”) govern your access to and use of PropLinker (“we”, “our”, or “us”), operated at proplinker.co. By creating an account or using the platform, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Description of Service

PropLinker is a platform for real estate professionals that converts Instagram Reels and other video content into structured property listings. The service includes video downloading, AI-powered audio transcription, property detail extraction, shareable microsite generation, and lead capture functionality.

2. Eligibility

You must be at least 18 years old and legally permitted to operate as a real estate agent or broker in your jurisdiction to use PropLinker. By using the service, you represent that you meet these requirements.

3. Your Account

You sign in via your Instagram account through Meta's OAuth service. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at legal@proplinker.co if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or misuse the platform.

4. Acceptable Use

You agree not to use PropLinker to:

• Upload or share content that is false, misleading, or fraudulent
• Publish property listings you do not have the right to market
• Infringe any third-party intellectual property rights
• Submit video content that violates Instagram's or any other platform's terms of service
• Collect or harvest personal data from public listing pages without consent
• Use the platform for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, scrape, or disrupt the service

5. Content Ownership and Licence

You retain ownership of all content you upload or create through PropLinker, including property details, descriptions, and contact information. By submitting content, you grant us a limited, non-exclusive licence to store, process, and display that content solely for the purpose of providing the service to you.

You are solely responsible for ensuring you have the rights to any video content you submit. If you submit an Instagram Reel, you warrant that you are the owner of that content or have the rights to use it commercially.

6. AI-Generated Content

PropLinker uses Google Gemini AI to transcribe audio and extract property information from your videos. AI-generated transcripts and field suggestions may contain errors. You are responsible for reviewing, correcting, and verifying all AI-generated content before publishing a listing. We make no warranty as to the accuracy of AI-generated output.

7. Public Listings

When you publish a listing, it is accessible to anyone with the link. You are solely responsible for the accuracy, legality, and appropriateness of your published listings. Do not publish pricing, availability, or property details that are inaccurate or intended to mislead buyers.

8. Lead Data

Buyer enquiries submitted via your public listing pages are personal data. You agree to handle this data responsibly, use it only for legitimate real estate communication, and comply with all applicable data protection laws. Do not spam, harass, or sell leads to third parties.

9. Fees and Payment

PropLinker may offer free and paid tiers. Pricing, billing terms, and any applicable limits will be communicated clearly at the time of purchase. All fees are in Indian Rupees (INR) unless otherwise stated. Fees paid are non-refundable except as required by applicable law.

10. Availability and Modifications

We aim to keep PropLinker available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that affect your use.

11. Third-Party Services

PropLinker integrates with third-party services including Meta (Instagram), Google Gemini AI, and others. Your use of those services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or conduct of third-party services.

12. Disclaimer of Warranties

PropLinker is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, merchantability, or non-infringement. We do not warrant that the service will be error-free, secure, or uninterrupted.

13. Limitation of Liability

To the fullest extent permitted by law, PropLinker and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including loss of data, revenue, or business opportunities. Our total liability for any claim shall not exceed the amount you paid us in the 30 days preceding the claim.

14. Indemnification

You agree to indemnify and hold PropLinker harmless from any claims, losses, damages, or expenses (including legal fees) arising from your use of the platform, your content, or your violation of these Terms.

15. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of PropLinker shall be subject to the exclusive jurisdiction of the courts in India.

16. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by updating the “Last updated” date. Continued use of the service after changes constitutes your acceptance of the updated Terms.
